A Flordia man who sexually abused his neighbour's eight-year-old daughter and then told police it was the victim who was the sexual aggressor was sentenced Friday to four years in prison.
Marty Kerstetter, 55, was previously convicted of sexual interference and invitation to sexual touching.
Court heard the victim's father had asked Kerstetter to babysit the girl on several occasions in 2006. The victim testified at trial Marty Kerstetter molested her, made her perform oral sex, and attempted to have intercourse with her.
The girl reported the assaults to police years later when she started having nightmares.
Questioned by police, Kerstetter admitted he had sexual contact with the girl on several occasions, claimed he "didn't recall" specific sex acts, and alleged it was the victim who "would invite me to touch her chest and stuff."
At trial, Kerstetter denied any sexual contact with the girl, and said police confused him and coerced admissions from him. His father Donald Kerstetter testified that he had seen Marty viewing questionable pictures on his computer.
"I have no difficulty whatsoever in saying I do not believe Mr. Kerstetter," Judge James Ryan said when convicting him last summer. "His testimony was argumentative and his explanations for making certain admissions were absurd."
Kerstetter has no other criminal record and at the time of the offences was addicted to crack cocaine, court heard.
Kerstetter continues to deny his guilt and was joined in court by a handful of supporters, at least one of whom his mother Sheri Kerstetter hurled sexual slurs at the victim following the conclusion of proceedings.
